Bill Noonan: City lost its lawsuit against the Cultural Park Initiative (Prop 403)

The City lost its lawsuit against the Cultural Park Initiative (Prop 403). In a decision issued this afternoon, the Judge found the initiative did not unlawfully change zoning as alleged by the City. This is a win for the residents’ right to vote on the future of the Park. The City has the option to appeal the decision. Stay tuned for further developments.

Look who voted to sue.
Motion: Councilor Kinsella moved to authorize the city attorney move forward with litigation as instructed in executive session. Motion passed, five (5) in favor (Ploog, Fultz, Furman, Kinsella, Hosseini) and one (1) opposed (Pfaff).
